THESE RULES ARE THE STANDARD TERMS AND CONDITIONS APPLICABLE TO THE ‘SEE  THE STARS SWEEPSTAKES’ (THE “SWEEPSTAKES”) ADMINISTERED BY BLUME SUPPLY INC., A CORPORATION REGISTERED UNDER THE LAWS OF BRITISH COLUMBIA, CANADA (“BLUME”). THE SWEEPSTAKES ARE INTENDED TO BE CONDUCTED IN CANADA ONLY AND SHALL BE CONSTRUED AND EVALUATED ACCORDING TO APPLICABLE CANADIAN LAW. NO PURCHASE IS NECESSARY. PARTICIPATION IS VOID IN WHOLE OR IN PART WHERE PROHIBITED BY LAW. ENTRY IN THE SWEEPSTAKES CONSTITUTES ACCEPTANCE OF THESE SWEEPSTAKES RULES (THE “SWEEPSTAKES RULES”).

1. ELIGIBILITY.
   1. Eligibility. To be eligible to enter the Sweepstakes, an individual (each an “Entrant”) must:
      1. be a legal resident of, and the age of majority in, their applicable Canadian Province;
      2. if applicable, be the sole owner of all right, title and interest (including copyright) in and to the Entrant’s sweepstakes submission (the “Submission”) submitted in connection with the Sweepstakes.
   2. Proof of Eligibility. Blume shall have the right at any time to require proof of identity and/or eligibility to participate in the Sweepstakes. Failure to provide such proof may result in disqualification.
   3. Accuracy of Information. All personal and other information requested by Blume for the purpose of the Sweepstakes must be truthful, complete, accurate and in no way misleading. Blume reserves the right, in their sole discretion, to disqualify any entrant should such an entrant at any stage supply untruthful, incomplete, inaccurate or misleading personal details and/or information.
2. SWEEPSTAKES PERIOD.
   1. Sweepstakes Period. The Sweepstakes shall be open for participation from April 8 to 11:59pm on August 31, 2026 (the “Sweepstakes Period”) after which time the Sweepstakes will be closed and no further entries shall be accepted.
3. ENTERING THE SWEEPSTAKES.
   1. No Purchase Necessary. There is no purchase necessary to enter the Sweepstakes.
   2. Entry. To enter, each Entrant must either:
      1. visit [https://itsblume.com/pages/peach-sweepstakes] (the “Sweepstakes Website”) and complete and submit the applicable Sweepstakes entry form along with a valid SuperBelly receipt or enter via mail as otherwise instructed through the Sweepstakes Website (each an “Entry”); or
      2. scan the QR code on any third party product bearing a participating link (each a “Participating QR Code”) awarded to the Entrant by Blume or its authorized affiliate (each an “Affiliate”) and follow such instructions as provided by such third party.
         
         For the purposes of the Sweepstakes, a “valid SuperBelly receipt” shall constitute a validly issued receipt for a purchase of any Blume SuperBelly product in Canada, excluding those purchased from any exempted retailer, including Costco Wholesale.
   3. Limit.  There is no limit on the number of Entries that may be submitted by an Entrant, provided that each applicable purchase receipt, Participating QR Code or written essay may only be used for one Entry.
   4. Late Entries. Entries must be received prior to the indicated Sweepstakes Period entry deadline. Entries will be declared invalid if they are late, illegible, incomplete, damaged, irregular, mutilated, forged, garbled or mechanically or electronically reproduced.
   5. Condition of Entries. All winning products containing Participating QR Codes have been inspected, produced, and confirmed to be completely legible. Liability for inaccessible, irregular or illegible, Participating QR Codes is limited to replacement with another Participating QR Code by the applicable Affiliate, while supplies last. Neither Blume, nor any Affiliate, shall be responsible for any lost or damaged Participating QR Codes. Participating QR Codes are the property of Blume and its Affiliates, and may not be used for any other promotional, commercial, or other purposes without the prior written authorization of Blume.
   6. Communications. No communication or correspondence will be exchanged with Entrants except with those selected as a potential Sweepstakes winner.
   7. Submitting Party.  Entries shall be deemed to be submitted by the authorized account holder of the e-mail address associated with the Entry, as applicable. For the purposes of these Sweepstakes Rules, “authorized account holder” of an e-mail address is defined as the natural person who is assigned to an e-mail address by an internet access provider, on-line service provider or other organization responsible for assigning e-mail addresses for the domain or account associated with the submitted e-mail address. Each selected Entrant may be required to provide Blume with proof that the selected Entrant is the authorized account holder of the e-mail address, Facebook or Twitter account associated with the winning entry.
   8. Conduct of the Entrant. Each Entrant understands and agrees that Blume or its Affiliates have the right, in their sole discretion, to disqualify and remove the Entrant (or winner) from any activity (inclusive of the Sweepstakes) at any time if the Entrant’s behavior at any point is uncooperative, disruptive, or may or does cause damage to person, property, or the reputation of Blume or the Affiliate, including, without limitation, the shopping premises of the Affiliate, or otherwise violates the policies of Blume or the Affiliate.
4. WINNER SELECTION.
   1. Selection. Following the conclusion of the Sweepstakes Period, Blume will select one (1) entrant for the Prize (the “Winner”) by a random draw from all eligible entries received during the Sweepstakes Period, unless otherwise indicated.
   2. One Prize Per Entrant. Each Entrant shall be eligible to win only one (1) prize.
   3. Odds. The odds of being selected as a potential Winner are dependent upon the number of eligible Entries received for the Sweepstakes, provided that approximately 1,200 Participating QR Codes shall be available for entry.
   4. Skill Testing Question. Before being declared a winner of each Prize, the selected Entrant shall be required to:
      1. correctly answer, without assistance of any kind, whether mechanical or otherwise, a time-limited mathematical skill-testing question to be administered during a pre-arranged telephone call or by e-mail;
      2. comply with these Sweepstakes Rules; and
      3. sign and return the Release, as defined below.
   5. Failure to Respond.  If the selected Entrant does not respond within the prescribed timeline set out in the notification, or fails to successfully comply with section 4.4 above. they will be disqualified and will not receive a Prize, and another Entrant may be selected, as determined by Blume in its sole discretion, until such time as an Entrant satisfies the terms set out herein. Blume is not responsible for the failure for any reason whatsoever of a selected Entrant to receive notification at the contact information submitted with their entry or for Blume to receive a selected Entrant’s response through the prescribed communication channel.
5. PRIZES.
   1. Prizes. The Sweepstakes prize (the “Prize”) shall have an approximate retail value of Five-Thousand Canadian dollars ($5,000.00) and shall be announced and described through Blume’s ecommerce website and social media accounts. Winners shall not be entitled to receive the difference between the actual prize value and the approximate prize value of each Prize. The Prize shall comprise one (1) $5,000 travel voucher with a travel provider selected at Blume’s sole reasonable discretion (the “Travel Provider”)
   2. No Transfer of Prizes. The Prize must be accepted as awarded and cannot be transferred, assigned, substituted or redeemed for cash, except at the sole discretion of Blume. Any unused portion of a Prize will be forfeited and have no cash value.
   3. Substitution. Blume reserves the right, in their sole discretion, to substitute a prize of equal or greater value if the Prize (or any portion thereof) cannot be awarded for any reason.
   4. Additional Expenses. Winners will be solely responsible for any expense not explicitly included in the Prize.
   5. No Liability. Blume shall not assume any liability for any lost or misdirected prize, including, without limitation, where such Winner provides inaccurate or incomplete shipping or contact information to Blume.
   6. Terms of Prize. The following terms and conditions shall apply to the Prize:
      1. Blume shall be solely responsible for the costs of the Prize and the Winner acknowledges and agrees that all other costs undertaken during all associated travel shall be borne by the Winner;
      2. the Winner’s use and availability of the Prize shall at all times be subject to the Travel Provider’s terms and conditions and Blume makes no representation of any availability of any specific destination or timing of any travel associated with the use of the Prize;
      3. the parties agree that the Travel Provider and associated hotel, airline, resort or other service provider with whom the Winner books such travel shall be solely responsible for all such services and Blume accepts no liability for any provision of any associated service, accommodation, or product provided to the Winner in connection with the use of the Prize;
      4. the Winner acknowledges that they shall be solely responsible for complying with all relevant rules or policies of any airline carrier, hotel, resort or the Travel Provider, and that any breach of any such policy or rule may result in the immediate expulsion of such person from such service and use of the Prize;
      5. each Entrant represents to Blume that the Winner, and each member of their travel group, shall:
         1. have a valid passport and all other applicable travel requirements, including, without limitation, appropriate vaccinations and immunizations and travel visas to travel to the Winner’s applicable destination;
         2. be medically fit to travel; and
         3. have in place reasonable travel insurance prior to departing any trip using the Prize.
6. LIMITATION OF LIABILITY AND RELEASE.
   1. Limitation of Liability. Blume and its Affiliates assume no responsibility or liability:
      1. for lost, late, unintelligible/illegible, falsified, damaged, misdirected or incomplete Entries, notifications, responses, replies, or for any computer, online, software, telephone, hardware or technical malfunctions that may occur, including but not limited to malfunctions that may affect the transmission or non-transmission of an Entry;
      2. for any incorrect or inaccurate information, whether caused by website users or by any of the equipment or programming associated with or utilized in the Sweepstakes or by any technical or human error which may occur in the administration of the Sweepstakes;
      3. for any error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, or alteration of, Entries; and
      4. in the event that the Sweepstakes cannot be conducted as planned for any reason, including those reasons beyond the control of Blume, such as infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or corruption of the administration, security, fairness, integrity or proper conduct of the Sweepstakes, the Sweepstakes website, or any applicable Affiliate.
   2. Release. Potential Winner(s) shall be required to execute a legal agreement and release (“Release”) that confirms their: (i) eligibility for the Sweepstakes  and compliance with these Sweepstakes Rules; (ii) acceptance of the Prize as offered; (iii) release of Blume and its Affiliates, employees, directors, officers, suppliers, agents, administrators, licensees, representatives, advertising, media buying and promotional agencies (collectively, the “Releasees”) from any and all liability for any loss, harm, damages, cost or expense arising out of participation in the Sweepstakes, use of the Prize, participation in any Sweepstakes-related activity or the acceptance, use, or misuse of any Prize, including but not limited to costs, injuries, losses related to personal injuries, death, damage to, loss or destruction of property, rights of publicity or privacy, defamation, or portrayal in a false light, or from any and all claims of third parties arising therefrom.
   3. Execution of Release. The executed Release(s) must be returned within five (5) business days of the date indicated on the accompanying letter of notification or verification as a Winner, or the selected Entrant will be disqualified and any rights he or she may have to the Prize will be forfeited.
7. INDEMNIFICATION BY ENTRANT.
   1. Indemnity. By entering the Sweepstakes, each Entrant agrees to indemnify and hold the Releasees, as defined above, harmless from any and all liability for any injuries, loss or damage of any kind to the Entrant or any other person, including personal injury, death, or property damage, resulting in whole or in part, directly or indirectly, from: (a) their participation in the Sweepstakes, use of the Prize or any related activity; (b) the acceptance, use, or misuse of any Prize; or (c) any breach of the Sweepstakes Rules. Each Entrant agrees to fully indemnify Releasees from any and all claims by third parties relating to the Entrant’s participation in the Sweepstakes, without limitation.
8. CONDUCT.
   1. Agreement to be Bound. By participating in a Sweepstakes, each Entrant agrees to be bound by the Sweepstakes Rules. Entrants further agree to be bound by the decisions of Blume, which shall be final and binding in all respects.
   2. Right to Disqualify. Blume reserves the right, in its sole discretion, to disqualify any Entrant found to be: (a) violating the Sweepstakes Rules; (b) tampering or attempting to tamper with any Participating QR Code, the entry process or the operation of the Sweepstakes, the Sweepstakes website, or any related promotional website; (c) violating the terms of service, conditions of use and/or general rules or guidelines of any Blume’s property or service; and/or (d) acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person.
9. PRIVACY / USE OF PERSONAL INFORMATION.
   1. Personal Information. By participating in the Sweepstakes, each Entrant:
      1. grants to Blume the right to use their personal information provided when he/she enters the Sweepstakes (collectively the “Personal Information”) for the purpose of administering the Sweepstakes, including but not limited to contacting and announcing the Winner(s) and coordinating the provision of the Prizes;
      2. grants to Blume the right to use their Personal Information for publicity and promotional purposes relating to the Sweepstakes in any and all media without further compensation unless prohibited by law;
      3. by entering the Sweepstakes, the Entrant agrees to receive from Blume, via email, publications, promotions, discounts, updates, invitations to events and marketing material relating to Blume’s business, provided that you will be entitled at any time to opt-out of such mailings; and
      4. acknowledges that Blume may disclose their Personal Information to third-party agents and service providers of Blume in connection with any of the activities listed in (i) and/or (ii) above.
   2. Types of Personal Information Collected. In connection with the Sweepstakes, Blume shall be collecting the following personal information relating to the Entrant (“Personal Information”):
      1. the Entrant’s name, email address and limited commercial information pertaining certain Blume products purchased by the Entrant;
   3. Use of Personal Information. Blume shall be using the Personal Information for following purposes:
      1. the administration of the Sweepstakes, including corresponding with winning Entrants;
      2. sending the Entrant marketing promotions, offers and correspondence in accordance with section 9.1(c) above;
      3. complying with all relevant laws or regulations;
      4. tracking Sweepstakes engagement and performance; and
      5. if applicable, to enforce any legal right of Blume.
   4. Storage of Personal Information. All Personal Information collected shall be stored using the HulkForm Builder application and Google cloud storage and shall only be retained by Blume for such time as is reasonably required for the purpose collected. Blume shall use appropriate methods to preserve the confidentiality of all Personal Information collected. Personal information may be transferred to other countries outside of Canada, including the United States of America. The Entrant may exercise its rights of rectification, access or erasure by contacting Blume at hello@itsblume.com.
   5. Privacy Policy. Blume will use the Entrant’s Personal Information only for identified purposes and protect the Entrant’s Personal Information in a manner that is consistent with Blume’s Privacy Policy.
10. INTELLECTUAL PROPERTY.
    1. Blume Intellectual Property. All intellectual property, including but not limited to trade-marks, trade names, logos, designs, promotional materials, web pages, source code, drawings, illustrations, slogans and representations used in conjunction with the Sweepstakes are owned by Blume and/or its affiliates. Unauthorized copying or use of any copyrighted material or intellectual property without the express written consent of its owner is strictly prohibited.
    2. License of Intellectual Property. By providing the Submission, if applicable, to Blume in connection with the Sweepstakes, each Entrant shall grant to Blume a worldwide, gratuitous, irrevocable, fully-paid up, royalty-free and exclusive licence to copy, use, modify, reproduce, display, adapt and transmit all intellectual property rights, including the Entrant’s likeness, in the Submission for use in all media now known or hereafter devised in perpetuity beginning on the date of entry, including, but not limited to, in connection with the administration, promotion and exploitation of the Sweepstakes and Blume’s products, including without limitation, posting the Submission on Blume owned or controlled websites, viewing galleries and/or social media platforms. The Entrant hereby confirms that the Submission is an original work, solely created by the Entrant, and that no third party participated as an author, co-author, photographer or otherwise in the creation of the Submission or any part thereof. Blume assumes no responsibility for any claims of infringement of rights to copyright, privacy and/or personality, and all such liability shall remain with the Entrant. In addition, each Entrant represents to Blume that the Submission does not infringe any copyright interest of any third party and that the Submission is not defamatory or obscene and does not violate any laws relating to hate speech or otherwise.
11. TERMINATION.
    1. Termination of Sweepstakes. Blume reserves the right, in their sole discretion, to terminate the Sweepstakes, in whole or in part, and/or modify, amend or suspend the Sweepstakes, and/or the Sweepstakes Rules in any way, at any time, for any reason without prior notice. Any such change to the Sweepstakes rules shall be effective as of the date of its posting.
12. GENERAL PROVISIONS.
    1. Governing Law. The Sweepstakes are subject to applicable federal, provincial and municipal laws and regulations. These Sweepstakes Rules are subject to change without notice in order to comply with any applicable federal, provincial and municipal laws or the policy of any other entity having jurisdiction over the Sweepstakes. All issues and questions concerning the construction, validity, interpretation and enforceability of the Sweepstakes Rules or the rights and obligations as between the Entrant and Blume in connection with the Sweepstakes shall be governed by and construed in accordance with the laws of the province of British Columbia without giving effect to any choice of law or conflict of law rules or provisions that would cause the application of any other jurisdiction’s laws.
    2. Severability. In the event that any portion of these Sweepstakes Rules are held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect its original intentions and the remainder of the provisions shall remain in full force and effect.
    3. Minimum Statutory Standards. In the event that these Sweepstakes Rules provide a lesser benefit than any applicable minimum standard contained in any governing legislation, such minimum standard shall prevail to the extent of the inconsistency.
    4. Social Media. This Sweepstakes is in no way sponsored, endorsed or administered by any social media platforms on which the Sweepstakes may have been promoted and/or publicized. Any questions or comments regarding the Sweepstakes must be directed to Blume and not to any of the social media platforms on which the Sweepstakes may have been advertised.
    5. Survival. The provisions of Sections 6 (Limitation of Liability and Release), 7 (Indemnification by Entrant) and 10 (Intellectual Property) shall survive the termination of the Sweepstakes, or any Entrant’s participation therein, for any reason.
    6. Discrepancy. These are the official Sweepstakes Rules.  In the event of any discrepancy or inconsistency between the terms and conditions of the Sweepstakes Rules and disclosures or other statements contained in any Sweepstakes-related materials, including but not limited to the Sweepstakes landing page, entry form, Blume point of sale, or social media or online advertising, the terms and conditions of these Sweepstakes Rules shall prevail, govern and control.
